X's New Terms: AI Chat Data Sharing, No Opt-Out, and Expanded User Liability
X, formerly known as Twitter, is updating its Terms of Service effective January 15, 2026, impacting user content and AI system operations. A key change is the broadened definition of “Content” to include AI-era interactions like prompts and outputs, making users responsible for what they share. X now has rights to reuse user content for any purpose, including AI model training, without compensation beyond service access. The updated terms also introduce a prohibited-conduct clause targeting AI circumvention attempts. Europe-specific language addresses content enforcement and user challenges under EU and UK law, including the UK Online Safety Act 2023. The new terms maintain restrictions on automated access and data collection, with liquidated damages for violations.
